Welcome to Indoor Playground Creations. These Terms of Service (“Terms”) govern your use of the Indoor Playground Creations website and your interactions with Indoor Playground Creations (“Indoor Playground Creations,” “we,” “us,” or “our”).
By accessing or using our website, submitting a request for a quote or design, purchasing products or services, or otherwise doing business with Indoor Playground Creations, you agree to these Terms, as applicable.
Please read these Terms carefully.
1. Our Products and Services
Indoor Playground Creations specializes in commercial indoor playground equipment and related products and services, which may include:
- Custom playground design
- Commercial indoor playground equipment
- Manufacturing and production
- Shipping and freight coordination
- Professional installation
- Replacement parts and components
- Warranty and customer support
Products, services, specifications, availability, pricing, and other information may change without notice.
2. Custom Designs and Proposals
Many Indoor Playground Creations products are custom-designed and manufactured based on information provided by the customer.
Customers are responsible for providing accurate information regarding their project, including measurements, ceiling heights, floor plans, site conditions, access requirements, intended age groups, and other information necessary to design and install the playground.
Designs, renderings, drawings, layouts, colors, dimensions, and images provided during the design process are intended to represent the proposed finished product. Minor differences may occur during engineering, manufacturing, or installation.
A project may require modifications to accommodate safety requirements, manufacturing limitations, site conditions, applicable standards, or other technical considerations.
3. Customer Approval
Before production begins, customers may be required to review and approve final designs, specifications, layouts, colors, dimensions, or other project details.
The customer is responsible for carefully reviewing all documents before providing approval.
Once a custom design has been approved and production has begun, changes may not be possible. If changes can be accommodated, additional costs and production time may apply.
4. Pricing and Quotes
Prices displayed on our website, marketing materials, photographs, or other materials are for informational purposes unless specifically stated otherwise.
Custom playground pricing depends on factors including size, design, features, materials, shipping destination, installation requirements, and site conditions.
Written proposals or quotes are valid for the period specified in the proposal. Pricing may change after the expiration of a quote.
Unless specifically included in a written proposal, pricing may not include taxes, permits, inspections, site preparation, electrical work, flooring, freight unloading, storage, or other third-party expenses.
5. Payment Terms
Unless otherwise stated in a written agreement or proposal, Indoor Playground Creations requires:
50% deposit to begin production of a custom playground and the remaining 50% payment two weeks prior to the playground shipping.
Production may not begin until the required deposit and all necessary approvals have been received.
Final payment must be received in accordance with the payment schedule before the product is released for shipment unless otherwise agreed to in writing.
6. Custom Orders and Cancellations
Because our playgrounds are custom-designed and manufactured for individual customers, deposits and payments will become non-refundable once design, engineering, material procurement, or manufacturing has begun.
Cancellation requests must be submitted in writing.
Any refund, if applicable, will be determined based on the stage of the project and costs already incurred by Indoor Playground Creations, its manufacturers, suppliers, or contractors.
Custom-manufactured products cannot be returned after production has begun or the product has been completed.
7. Production Timelines
Production and delivery timelines are estimates unless expressly guaranteed in writing.
Estimated timelines may be affected by circumstances including:
- Design changes or delayed approvals
- Manufacturing schedules
- Material availability
- Supply-chain disruptions
- Freight or transportation delays
- Customs or import delays
- Weather
- Labor shortages
- Site readiness
- Events beyond our reasonable control
Indoor Playground Creations is not responsible for losses resulting from reasonable manufacturing, shipping, or installation delays outside of our control.
8. Shipping and Delivery
Products may be shipped directly from the manufacturing facility to the customer’s designated location.
Customers are responsible for providing accurate shipping and delivery information and ensuring that the delivery location can accommodate the shipment.
Unless otherwise specified in writing, the customer is responsible for arranging and providing the equipment, personnel, and access necessary to unload the playground equipment when it arrives.
Customers should inspect shipments promptly and notify Indoor Playground Creations of visible damage, missing items, or other shipping concerns as soon as reasonably possible.
Freight damage may also be subject to the policies and claim requirements of the applicable shipping carrier.
9. Installation
When professional installation is included in the customer’s agreement, Indoor Playground Creations will coordinate for trained installers to assemble and install the playground equipment at the customer’s location.
The customer is responsible for ensuring that the installation site is ready before the installation team arrives.
Site-readiness requirements may include:
- An empty and accessible installation area
- Completed flooring or other required construction
- Adequate electrical service, if applicable
- Appropriate loading and unloading access
- Equipment having been unloaded and placed in an agreed staging area
- Required permits or approvals
- Safe working conditions
- Access to the facility during scheduled installation times
Delays caused by an unprepared site, unavailable equipment, restricted access, construction delays, or other customer-related circumstances may result in additional charges.
10. Permits, Codes, and Site Requirements
Customers are responsible for determining and obtaining any permits, licenses, inspections, landlord approvals, fire department approvals, building department approvals, or other governmental approvals required for their facility unless expressly stated otherwise in writing.
Building codes and requirements vary by jurisdiction. Customers should verify local requirements before purchasing and installing playground equipment.
Indoor Playground Creations may provide product specifications or other documentation to assist with the approval process but does not guarantee that a particular design will satisfy every local building, zoning, fire, accessibility, licensing, or other regulatory requirement.
11. Safety and Proper Use
Commercial playground equipment must be properly supervised, operated, inspected, maintained, and used according to applicable safety instructions and intended-use guidelines.
The customer or facility operator is responsible for:
- Proper supervision of children and guests
- Routine inspection of playground equipment
- Maintaining a safe play environment
- Promptly addressing damaged or worn components
- Following recommended maintenance procedures
- Enforcing posted rules, age restrictions, capacity limits, and other safety requirements
- Preventing improper or unauthorized use of equipment
Playground equipment should not be used when damaged or when conditions may make its use unsafe.
12. Warranty
Indoor Playground Creations provides an 18-month warranty covering qualifying manufacturing defects, subject to the specific terms, limitations, and exclusions contained in our applicable warranty policy.
The warranty generally does not cover damage caused by misuse, abuse, normal wear and tear, improper maintenance, unauthorized modifications, vandalism, accidents, environmental conditions, or installation performed contrary to applicable instructions.
The complete warranty policy available through Indoor Playground Creations governs warranty claims and supersedes any general warranty description contained in these Terms.
13. Product Images and Website Information
Photographs, renderings, videos, dimensions, descriptions, colors, specifications, and other materials appearing on our website are provided for informational and illustrative purposes.
Because many products are customized, the final product may differ from photographs, renderings, or examples shown on our website.
Colors may also appear differently depending on screens, lighting, materials, manufacturing processes, and other factors.
We make reasonable efforts to maintain accurate website information but do not guarantee that every description, photograph, specification, price, or other item of information will always be complete or error-free.
14. Intellectual Property
All website content, including text, photographs, graphics, logos, designs, renderings, drawings, layouts, videos, and other materials, is owned by or licensed to Indoor Playground Creations unless otherwise stated.
Such content may not be copied, reproduced, distributed, modified, published, displayed, sold, or used commercially without prior written permission.
Custom playground designs, drawings, renderings, and proposals created by Indoor Playground Creations remain protected intellectual property to the extent permitted by applicable law and may not be provided to competitors or used to reproduce the design through another manufacturer without authorization.
15. Acceptable Website Use
You agree not to use our website:
- For unlawful or fraudulent purposes
- To interfere with website security or operation
- To attempt unauthorized access to our systems
- To introduce malicious software or harmful code
- To collect information from the website through unauthorized automated means
- To infringe upon our intellectual property rights or those of another party
We reserve the right to restrict access to our website when we reasonably believe these Terms have been violated.
16. Third-Party Services and Links
Our website may contain links to third-party websites, platforms, payment processors, social media services, or other external resources.
Indoor Playground Creations does not control these third parties and is not responsible for their content, availability, security, terms, or privacy practices.
17. Disclaimer of Warranties
Except for warranties expressly provided in writing by Indoor Playground Creations, our website and its content are provided on an “as is” and “as available” basis to the fullest extent permitted by applicable law.
We do not warrant that our website will always be uninterrupted, error-free, secure, or free from harmful components.
Product warranties are governed by the applicable written warranty provided with the product or purchase agreement.
18. Limitation of Liability
To the fullest extent permitted by applicable law, Indoor Playground Creations will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of our website, products, or services.
Indoor Playground Creations is not responsible for injuries or damages resulting from misuse, inadequate supervision, unauthorized modification, improper maintenance, failure to follow safety instructions, or continued use of damaged or unsafe equipment.
Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.
19. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Indoor Playground Creations and its owners, employees, representatives, contractors, and affiliates from claims, damages, liabilities, losses, and reasonable expenses arising from your misuse of our website or products, violation of these Terms, or failure to properly operate, supervise, inspect, or maintain playground equipment.
20. Force Majeure
Indoor Playground Creations will not be responsible for delays or failure to perform caused by events beyond our reasonable control, including natural disasters, severe weather, fires, floods, earthquakes, labor disputes, transportation disruptions, government actions, supply-chain disruptions, shortages, epidemics, pandemics, war, civil unrest, or similar events.
21. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
22. Privacy
Your use of our website is also subject to our Privacy Policy, which explains how Indoor Playground Creations collects, uses, and protects personal information.
23. Changes to These Terms
Indoor Playground Creations may update these Terms periodically.
Changes will become effective when the revised Terms are posted on our website unless otherwise stated. The effective date shown at the top of this page indicates when these Terms were most recently updated.
24. Separate Agreements
A customer proposal, purchase agreement, invoice, installation agreement, warranty, or other written agreement may contain terms specific to an individual project.
If there is a conflict between these website Terms and a separately executed written agreement governing a specific purchase or project, the terms of the separately executed agreement will control with respect to that purchase or project.
